LoanKit is a software-as-a-service lending management system provided to lending companies ("you", the "Subscriber") to manage your own borrowers, loans, payments, collections, and reporting. LoanKit (Ascendryx Information Technology) is a technology provider. LoanKit is not a lender, financing company, or credit provider, and does not make lending decisions, provide funds, or collect on your behalf except as tools you operate.
You are responsible for the accuracy of your registration details, for all activity under your account and staff users, and for keeping credentials secure. You must be a duly registered lending/financing entity where required by law and must comply with all laws applicable to your business.
You agree not to misuse the service, including: uploading unlawful content; attempting to access other subscribers' data; interfering with or overloading the service; using scrapers, bots, crawlers, headless browsers, automated scripts, or artificial-intelligence tools to access or extract the service other than your own ordinary operational use; or using LoanKit to violate lending, consumer-protection, data-privacy, or anti-money-laundering laws.
LoanKit — including all software, source code, object code, application programming interfaces (APIs), databases and data models, user interfaces, screen designs, layouts, workflows, feature designs, documentation, and the overall "look and feel" — is and remains the exclusive property of Ascendryx Information Technology and is protected by copyright, trademark, trade-secret, and other intellectual-property laws. Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to use LoanKit to operate your own lending business. It grants you no ownership of, and no rights in, the software, its design, or its underlying know-how.
You must not, whether directly, indirectly, through any third party, or by any automated means:
Frontend code that necessarily runs in your browser or mobile app is provided solely so you can operate the service; being able to view it confers no licence to copy, reuse, or reconstruct it. Any suggestions or feature requests you provide may be used by us to improve LoanKit without obligation to you, and all resulting improvements remain our property. Your borrower and business data remains yours (see the data sections below); everything else — the platform and its know-how — remains ours. Breach of this section is a material breach that permits immediate suspension or termination and may entitle us to injunctive relief and damages in addition to any other remedy.
You control the borrower personal data you enter. As between you and LoanKit, you are the personal-information controller and LoanKit acts as your processor, handling data on your instructions to provide the service (see the Privacy & Data Processing terms). You are responsible for obtaining any borrower consents and for lawful collection and use of that data.
Subscription fees, trial terms, and any add-on charges are as presented at sign-up or in your plan. Fees are billed on the stated cycle. Non-payment may lead to suspension after a grace period. Optional programs (such as the LoanKit Qualified Leads marketplace) are governed by their own separate agreement.
We work to keep LoanKit available and reliable but do not guarantee uninterrupted service. We may perform maintenance and will make reasonable efforts to minimize disruption.
The service is provided "as is." To the maximum extent permitted by law, LoanKit is not liable for your lending decisions, borrower defaults, lost profits, or indirect damages. LoanKit's total liability is limited to the fees you paid in the preceding period, as finalized by counsel.
You may stop using the service at any time. We may suspend or terminate for breach of these terms or non-payment. On termination you may request an export of your data within a reasonable period.
We may update these terms; material changes will be notified in-app or by email, and continued use constitutes acceptance of the updated version.
These terms are governed by the laws of the Republic of the Philippines. [Venue / dispute-resolution clause to be finalized by counsel.]
